A temporary employment clause is an arrangement you agree to in your employment agency agreement. It means your work stops when the employment agency’s client says there is no more work. This arrangement is allowed only in the first 52 weeks you work.
If you become sick and you have an agency contract with a temporary employment clause, your contract can end immediately. If you come under the ABU CAO or NBBU CAO, your contract will continue when you are sick. Your employer must then continue to pay your wages while you are sick. If you do not know if you are covered by a CAO, check your contract or ask Het Juridisch Advice Bureau or SNCU.
If you are not covered by a CAO, your contract can end immediately if your work is stopped by the company you work for. You will have no right to any wages from the employment agency. You may be able to get sickness benefit from UWV. It is important that you report sick immediately to your employment agency as well as the company where you work. Your employment agency can apply for sickness benefit on your behalf.
