In the Netherlands, employers are allowed to dismiss employees with immediate effect if there is an urgent reason, such as theft or fraud. This is called summary dismissal.
In the case of summary dismissal, the employer does not have to take a notice period into account and your contract ends immediately. You will also no longer receive any wages and will usually not receive any benefit from UWV.
Your employer is only allowed to dismiss you if there is an urgent reason, for example you have been stealing from work, or you have put people in danger, shared trade secrets or refused to work.
The employer must tell you this reason straight away. In other words, the amount of time between the incident that occurred and your dismissal must be brief. In addition, the employer must be able to prove the reason. Summary dismissal is not valid if there is no evidence.
Your employer is likely to give you a letter stating that you have been summarily dismissed. This letter usually states the urgent reason for your dismissal. If you are not sure your employer is right, contact Het Juridisch Loket.
If you are a temporary agency worker, in certain cases your contract might end with immediate effect. This is not necessarily summary dismissal, and in many cases it is due to the effect of the temporary employment clause.
Some employers will ask you to sign a document. This is not compulsory, and you do not need to sign anything. If you do sign the document, it might you stop you from being able to claim any more unemployment benefit. Ask your employer if you can have a copy of the document. If you have already signed a document, contact Het Juridisch Loket as soon as possible.
If you have committed a crime, such as theft or assault, your employer can consider this an urgent reason for summary dismissal. Your employer does not have to ask UWV or a court for permission to do this. Your work will stop immediately and you will not receive any wages. You will also no longer have a right to unemployment benefit (WW).
